Welcome to The Office Caterer! These Terms and Conditions (“Terms” or “Agreement”) govern your use of our website https://theofficecaterer.com, our catering services, staffing services, social event coordination, event rentals (provided through our affiliate High Table Event at hightableevent.com), and any communications you receive from us including SMS text messages.
By accessing our website, submitting a booking inquiry, placing an order, or engaging our services in any capacity, you agree to be bound by these Terms. If you do not agree with any part of these Terms, please do not use our website or services.
1. Definitions
- Company, we, us, or our – Refers to The Office Caterer, located at 16201 Scientific, Irvine, CA 92618.
- Service – Includes our website, catering offerings, staffing services, social event coordination, event rental referrals, SMS notifications, and any related communication channels.
- User, you, or your – Any individual or business entity accessing or using our website or services.
- Order – Any catering, staffing, event coordination, or rental request submitted to and confirmed by The Office Caterer.
- Event – Any corporate gathering, social occasion, wedding, celebration, or other function for which our services are engaged.
- Booking Confirmation – Written confirmation (email or signed agreement) issued by The Office Caterer acknowledging acceptance of your Order.
2. Services Offered
The Office Caterer provides the following services, each subject to availability and separate service agreements where applicable:
2.1 Gourmet Catering
We provide professional food and beverage catering for corporate events, office meetings, team lunches, and large-scale gatherings. Menu options, pricing, and delivery details are confirmed at the time of booking.
2.2 Staffing Services
We supply trained catering and event staff including servers, bartenders, and event coordinators. Staffing requests are subject to availability and must be confirmed in writing. Clients are responsible for providing a safe and accessible working environment for all staff. The Office Caterer retains full employer responsibility for all placed staff members.
2.3 Social Events
We offer full-service catering coordination for social events including weddings, birthday celebrations, holiday parties, and private gatherings. Social event packages are customized and require a signed service agreement and deposit to secure the date.
2.4 Event Rentals
Event rental equipment (tables, linens, furniture, decor, etc.) is provided through our affiliate, High Table Event (hightableevent.com). Rental bookings are subject to High Table Event’s own terms and conditions. The Office Caterer is not responsible for rental equipment availability, condition, or disputes arising from rental agreements.
3. Website Use
The content on our website is provided for general informational purposes about our services. By using our website, you agree not to:
- Copy, reproduce, distribute, or commercially exploit any website content without prior written permission from The Office Caterer.
- Upload or transmit viruses, malware, or any harmful code.
- Attempt to gain unauthorized access to any part of our website or systems.
- Use our website for fraudulent, unlawful, or abusive purposes.
- Scrape, crawl, or collect data from our website using automated tools without written consent.
We reserve the right to update, modify, or remove website content at any time without notice and to restrict access to any user who violates these Terms.
4. Orders, Quotes, and Bookings
All service requests are subject to acceptance and availability. Quotes provided via phone, email, or website inquiry forms are estimates only and are not binding until a formal Booking Confirmation has been issued by The Office Caterer.
4.1 Booking Process
- Submit your inquiry through our website contact form, by phone, or by email.
- Receive a formal quote from our team outlining services, pricing, and event details.
- Review and approve the quote and pay the required deposit to secure your booking.
- Receive a written Booking Confirmation from The Office Caterer.
No booking is considered confirmed until the deposit has been received and a Booking Confirmation has been issued.
4.2 Deposits and Final Payments
- A non-refundable deposit is required to reserve catering, staffing, or social event services. The deposit amount will be specified in your quote.
- Final payment is due no later than 72 hours prior to the scheduled event unless otherwise agreed upon in writing.
- For large-scale events or custom packages, a payment schedule may be established in the service agreement.
- Accepted payment methods include major credit cards, ACH bank transfer, and any other methods specified at the time of booking. All payments are processed securely.
4.3 Late Payments
Payments not received by the agreed due date may result in suspension or cancellation of services. The Office Caterer reserves the right to charge a late fee of up to 1.5% per month on outstanding balances, or the maximum amount permitted by California law, whichever is less.
5. Cancellations, Rescheduling, and Refunds
5.1 Client Cancellations
- Cancellations made more than 14 days before the event: Deposit is forfeited; all other payments will be refunded.
- Cancellations made 7 to 14 days before the event: 50% of the total order value is due.
- Cancellations made less than 7 days before the event: 100% of the total order value is due to cover preparation, staffing, and ingredient costs.
- No-shows or same-day cancellations: Full payment is due and deposits are forfeited.
5.2 Rescheduling
Rescheduling requests made more than 14 days before the event will be accommodated subject to availability at no additional charge. Rescheduling requests made within 14 days of the event may incur a rescheduling fee and are subject to availability.
5.3 Cancellation by The Office Caterer
In the event we must cancel due to circumstances within our control, you will receive a full refund of all payments made. If cancellation is due to a Force Majeure event (see Section 11), we will work with you to reschedule or provide a credit toward a future booking.
6. Pricing and Availability
Prices displayed on our website and in quotes are subject to change without notice. We make every effort to ensure pricing accuracy; however, in the event of a pricing error, we reserve the right to correct the price before issuing a Booking Confirmation. You will be notified of any discrepancy and given the option to proceed at the corrected price or cancel without penalty.
Prices do not include applicable taxes, gratuity, delivery fees, or service charges unless explicitly stated. These will be itemized in your final quote.
7. Allergens and Dietary Accommodations
The Office Caterer takes food safety seriously and makes every effort to accommodate dietary restrictions and special requests. However, please be aware of the following:
- We cannot guarantee that any food item is entirely free from allergens including but not limited to: nuts, tree nuts, dairy, eggs, wheat/gluten, soy, fish, and shellfish.
- Cross-contamination may occur in our kitchen or during transport and setup.
- Customers are solely responsible for communicating all allergies, dietary restrictions, and medical dietary needs in writing prior to order confirmation.
- The Office Caterer is not liable for allergic reactions or dietary complications arising from failure to disclose restrictions or from cross-contamination despite reasonable precautions.
If you or your guests have severe or life-threatening allergies, please discuss this with our team before placing an order so we can advise on the safest options available.
8. Event Setup, Delivery, and Liability
8.1 Delivery and Setup
The Office Caterer will deliver, set up, and where applicable collect catering equipment according to the confirmed order details. Delivery windows will be communicated at the time of booking. Clients are responsible for:
- Ensuring safe, unobstructed access to the venue for our staff and vehicles.
- Providing accurate venue address and access instructions.
- Coordinating with venue management to allow entry at the agreed time.
- Ensuring adequate space for food setup, service stations, and staff operations.
8.2 Limitations of Liability for Delivery
The Office Caterer is not liable for delays, service interruptions, or damages caused by:
- Adverse weather conditions or natural disasters
- Road closures, traffic delays, or vehicle breakdowns beyond our control
- Inaccurate or incomplete delivery information provided by the client
- Venue access restrictions or denied entry
- Third-party contractor or vendor failures
8.3 Equipment and Property
Clients are responsible for any loss, theft, or damage to catering equipment, serving ware, or other property belonging to The Office Caterer that occurs while on the client’s premises. Any damaged or missing items will be billed to the client at replacement cost.
9. SMS Messaging Terms
By providing your phone number and opting in (via our website, phone, or in-person), you consent to receive SMS text messages from The Office Caterer regarding:
- Order confirmations and booking updates
- Delivery notifications and event day reminders
- Promotional offers and special events
- Important service updates
Message frequency varies based on your activity. Message and data rates may apply. You may opt out at any time by replying STOP. Reply HELP for assistance or contact us at info@theofficecaterer.com or (888) 534-4440.
We do not sell or share your phone number with third parties for their own marketing purposes. Mobile carriers are not liable for delayed or undelivered messages. Consent to SMS messaging is not a condition of purchase.
10. User-Generated Content
If you submit reviews, testimonials, photos, comments, or other content (“User Content”) through our website, social media, or directly to us, you grant The Office Caterer a non-exclusive, worldwide, royalty-free, perpetual license to use, reproduce, modify, display, and distribute such content for marketing, promotional, and business purposes.
By submitting User Content, you represent and warrant that:
- You own or have the right to submit the content.
- The content does not violate the rights of any third party, including privacy, intellectual property, or publicity rights.
- The content is accurate and not misleading.
We reserve the right to remove any User Content at our discretion that we determine to be inappropriate, offensive, inaccurate, or in violation of these Terms.
11. Force Majeure
The Office Caterer shall not be held liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond our reasonable control, including but not limited to:
- Acts of God, natural disasters, earthquakes, floods, or severe weather
- Pandemics, epidemics, or public health emergencies
- Government-mandated closures, restrictions, or orders
- Fire, power outages, or infrastructure failures
- Labor strikes or supply chain disruptions
In such events, we will notify you as soon as practicable and work with you to reschedule or identify an alternative solution. If services cannot be rescheduled within a reasonable time, we will issue a credit toward a future booking.
12. Privacy and Data Protection
Your use of our services is governed by our Privacy Policy, available at https://theofficecaterer.com/privacy-policy/. Our Privacy Policy explains how we collect, use, and protect your personal information, including your rights under the California Consumer Privacy Act (CCPA). By using our services, you acknowledge and agree to our data practices as described in the Privacy Policy.
13. Third-Party Services and Links
Our website may contain links to or integrations with third-party websites, platforms, or services not owned or controlled by The Office Caterer. These include but are not limited to:
- High Table Event (hightableevent.com) – Our affiliated event rental provider
- ChowNow – Our online ordering platform
- Google Analytics and Meta Pixel – Analytics and advertising tools
- Payment processors (e.g., Stripe)
We are not responsible for the content, privacy policies, practices, or accuracy of any third-party services. Your use of third-party services is at your own discretion and subject to their respective terms.
14. Intellectual Property
All content on our website, including but not limited to text, graphics, logos, images, photographs, menu designs, and software, is the property of The Office Caterer or used under license and is protected by applicable copyright and trademark laws.
You may not reproduce, distribute, modify, create derivative works from, or commercially exploit any of our intellectual property without prior written permission. Limited personal, non-commercial use of our website content is permitted provided you do not remove any copyright or proprietary notices.
15. Disclaimer of Warranties
Our services and website are provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
We do not warrant that:

- The results obtained from using our services will meet your specific expectations.

16. Limitation of Liability

Our total cumulative liability to you for any claim arising from or related to these Terms or our services shall not exceed the total amount you paid to The Office Caterer for the specific service giving rise to the claim in the twelve (12) months preceding the claim.
Some jurisdictions do not allow limitations on implied warranties or exclusion of certain damages. In such cases, our liability will be limited to the maximum extent permitted by law.
17. Indemnification
You agree to indemnify, defend, and hold harmless The Office Caterer, its affiliates, officers, directors, employees, contractors, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to:

- Your breach of these Terms
- Your violation of any applicable law or regulation

18. Dispute Resolution

18.2 Binding Arbitration
If informal resolution is unsuccessful, any dispute, claim, or controversy arising out of or relating to these Terms or our services shall be resolved by binding arbitration administered in Orange County, California, in accordance with the applicable rules of the American Arbitration Association (AAA), except that either party may seek injunctive or other equitable relief in a court of competent jurisdiction where necessary to protect intellectual property rights or prevent imminent harm.
18.3 Class Action Waiver
You agree that any dispute resolution proceedings will be conducted on an individual basis only. You waive any right to participate in a class action lawsuit or class-wide arbitration against The Office Caterer.
19. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. Any legal action not subject to arbitration under Section 18 shall be brought exclusively in the state or federal courts located in Orange County, California, and you consent to the personal jurisdiction of such courts.
20. Modifications to These Terms
We reserve the right to update or modify these Terms at any time. When we do, we will:
- Update the “Last Updated” date at the top of this page.
- Post the revised Terms on this page.
- For material changes, provide notice via email or a prominent notice on our website prior to the change taking effect.
Your continued use of our website or services after changes are posted constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you must discontinue use of our services.
21. Severability and Entire Agreement
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
